This service agreement is the foundation of our coaching relationship. Please take the time to read this service agreement carefully before using the jvictoria.us site or any of its subdomains, or any associated services so you and I can maximize the benefits you receive from our coaching sessions.
By accessing this website and any subdomains, related software, services, and/or materials, you are agreeing to be bound by this service agreement, and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained in this website is the sole property of J. Victoria ELA and Coaching, LLC.
In this agreement, the service agreement and terms of use will be referred to as “terms,” “terms of use,” “terms and conditions,” “service Agreement,” or “agreement”. The jvictoria.us site and any of its subdomains or pages will be referred to as the “website,” or “site.” Any services offered by J. Victoria ELA and Coaching, LLC will be referred to as “services.” You will be referred to as “Client,” the “user,” or “you”. J. Victoria ELA and Coaching, LLC will be referred to as “I” “me,” “us,” or “we.”
Roles and Responsibilities
I will do everything possible to guide and support you, and to help you reach the outcomes you strive for and achieve your specific goals.
I will carefully assess and identify your strengths and needs for the purpose of providing lesson, course, and self study plans that will help you reach your specific goals.
I will work with you to identify solutions, offer advice and suggestions, and highlight possibilities and opportunities based on my own experiences, training, and the information available to me.
You are responsible for the time, effort, and dedication you put into your coaching sessions and self study, as well as the progress you make and the outcomes you ultimately achieve.
You accept full responsibility for your own progress, including all outcomes, decisions, and courses of action.
I will depend on you for your feedback about the course plan, lesson work, and self study work, to better understand what you find helpful or unhelpful, what you prefer, and what your wishes are for all aspects of our plans moving forward. Without being informed and fully aware of your goals and preferences, I will be unable to plan accordingly, or adjust our plans if your preferences have changed.
You, as a Client, by using my services and the services provided on this website, acknowledge that I am not a licensed financial, legal, investment, real estate, accounting, medical, or mental health professional, and do not carry any certification or licensing not explicitly listed in my publicly available information on this website. Any discussion between us involving these or similar areas in which I am not a licensed professional occurs solely to provide an opportunity for you to discuss your thoughts and consider all possibilities, and my participation in such discussions should not be taken as professional advice.
Confidentiality
I will not disclose your name or that you are in a coaching relationship without your written consent.
I may, at times, share certain my own experiences as a coach for the purpose of assisting my clients, such as common difficulties and useful strategies for improvement that I have found helpful in my coaching methods, however, this will not include information that could personally identify any client.
You are at all times free to discuss our coaching relationship with anyone.
Copies of all of our coaching notes and plans, and other relevant information will be provided via direct Google Drive folder sharing to your email address of choice, or by open access with a link, if that is your preference. Please feel free to let me know if you would prefer a different arrangement, and I will happily work with you to provide these materials in another way.
You may use the website without providing personally identifiable information. When using the Services, you may be requested to provide your personal data. To learn more about my privacy practices, please refer to my Privacy Policy.
Scheduling
You and I will schedule coaching sessions in advance, through direct communication and mutual agreement/confirmation. This is typically done via Google Calendar, in which case an automated Google Calendar will be sent to the email address you have provided for the purpose of correspondence related to our course. Please be sure to accept calendar events so that I will know you plan to attend our sessions.
If you are unable to attend a scheduled coaching session, you will provide notice of cancellation via email at jvictoria@jvictoria.us, or another method to which we have previously agreed.
Cost of the session will be refunded to your balance if notice of cancellation is received at least 24 hours before the session start time. Cost of the session will be forfeit if notice of cancellation is received less than 24 hours before the session start time. Sessions that have begun or have been completed will not be refunded. Refunds, transfers, and/or credits will not be provided for no-shows.
If I am unable to attend a session, I will inform you as early as possible, and the cost of the missed session will be refunded to you or your balance.
Our mutual commitment to the coaching process and relationship is paramount. It is unlikely that I will be able to assist you in making progress and reaching your objectives in the event of excessive absences. I reserve the right to temporarily suspend and/or permanently discontinue coaching relationships with clients who cancel and/or reschedule excessively.
These conditions are subject to change.
Free Phone Calls and Messaging Time
Phone calls, messages, and emails outside of scheduled sessions are provided as a free additional service to provide you with the best value and results possible.
Please feel free to send information outside of or ahead of our scheduled sessions. If possible, please let me know if you want immediate feedback, or simply want to review and/or discuss the information you have sent in our next session. I will make every attempt to reply to messages that require more rapid attention, and review relevant information before our sessions if time allows.
There may be occasions when I will be unable to correspond or answer questions outside of our scheduled sessions, but I will do my best to get back to you as soon as possible.
Payments and Refunds
Payment for coaching sessions will be made in advance of the session(s).
If courses are purchased at special, discount, and/or package pricing, the payment will be non-refundable.
Remaining balances (unused coaching hours) of packages purchased at standard hourly pricing will be refundable upon written request to jvictoria@jvictoria.us.
Refunds will not be provided for completed sessions or under the circumstances described in this service agreement.
I reserve the right to discontinue sessions with any client at any time. In the event that I discontinue the coaching relationship with a client, the client will be fully refunded for all unused coaching hours/balance as outlined in this service agreement.
Payment processing on the website and transacted directly with me is provided by third-party payment processors including, but not limited to PayPal, Stripe, Zelle, and Venmo, allowing me to bill Clients in lieu of directly processing your credit/debit card information.
To the fullest extent permitted by law, any refunds at any time are at my sole discretion only.
Materials and Use License
You have permission to temporarily download one copy of the materials on the website or from provided class materials for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:
modify or copy the materials;
use the materials for any commercial purpose or for any public display;
attempt to reverse engineer any software contained on the website;
remove any copyright or other proprietary notations from the materials; or
transfer the materials to another person or entity, or “mirror” the materials on any other server.
I reserve the right to terminate upon violations of any of these limitations. Upon termination, your viewing right will also be terminated and you should destroy any downloaded materials in your possession whether it is printed or electronic format.
Amendments to this Agreement
This service agreement may be modified and/or amended at any time by posting a revised version on the website. The latest version is published on this page. I encourage you to check this page regularly. If you do not agree with the amendments to this service agreement, you have the right to terminate this agreement by discontinuing your use of the services and providing a termination notice to jvictoria@jvictoria.us and/ or deleting your account. By continuing to use the website and services following the amendment of this service agreement, you consent to be bound by the service agreement as amended.
Disclaimers and Legal Information
Services are available only to individuals who are 18 years and older and who can form legally binding contracts under applicable laws. Individuals under the age of 18 may use these services only in conjunction with and under the supervision of a parent or a legal guardian. The parent or the legal guardian shall at all times be responsible for any and all activities related to the use of the Services by the aforementioned individuals.
By using the Site, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Terms of Use; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (4) you will not use the Site for any illegal or unauthorized purpose; and (5) your use of the Site will not violate any applicable law or regulation. I may change the materials contained on the website at any time without notice, however, I do not make any commitment to update the materials.
J. Victoria ELA and Coaching, LLC or its suppliers or affiliates will not be held accountable for any damages that will arise with the use or inability to use the materials on J. Victoria ELA and Coaching, LLC’s Website, even if J. Victoria ELA and Coaching, LLC or an authorize representative of this Website has been notified, orally or written, of the possibility of such damage.
I have not fully reviewed all of the sites linked to the website and I am not responsible for the contents of any such linked site. The presence of any link does not imply my endorsement, or endorsement by J. Victoria ELA and Coaching, LLC of the site. The use of any linked website is at the user’s own risk.
This service agreement, and any other agreements or terms available on the website, are legally binding agreements governing the relationship between J. Victoria ELA and Coaching, LLC and any User (as defined below) or visitor of the J. Victoria ELA and Coaching, LLC Website and/or Services. As a User or a visitor of the J. Victoria ELA and Coaching, LLC Website and/or Services, the collection, use, and sharing of your personal data are subject to the Privacy Policy and other policies, as may be amended from time to time.
You are responsible for obtaining and paying for any equipment and Internet service necessary to access the website or services. We may alter, suspend, or discontinue the J.
